Eligibility Criteria for Chartered Accountants

  1. A Chartered Accountant may train an articled assistant if their primary occupation is the practice of accountancy during the engagement of the assistant and throughout the qualifying years they cite for eligibility.

  2. Members engaged in other businesses or part-time certificate practice are not permitted to train articled assistants.

  3. Members working as paid assistants or partners in foreign Chartered Accountant firms are eligible to train articled assistants equivalent to paid assistants in India. Such foreign firms must have at least one partner who is a member of the Institute or eligible for membership as per the Mutual Recognition Agreement (MRA).

  4. Members must provide a professional address as outlined in Regulation 2(1)(xiii) and an address in India. This regulation specifies:

    • a. The professional address should be the principal place where the member practices.
    • b. For employed members, the address can be their place of employment or residence.
    • c. If neither applies, the residence address must be used.

    An address in India is mandatory in all situations.

Training Conditions

  1. The terms and conditions for training articled assistants in India will apply equally to training conducted abroad.

  2. The practical training period shall be 3 years or 3½ years under a practicing Chartered Accountant abroad. Additionally, articled/audit assistants can opt for industrial training in accordance with Regulations 51 and 72 of the Chartered Accountants Regulations, 1988, during the last year of their training.

  3. Industrial training may be offered by Chartered Accountants in foreign financial, commercial, or industrial entities meeting minimum fixed asset, turnover, or paid-up capital benchmarks established by the Council. For members employed abroad unable to provide corporate financial reports, a self-declaration can accompany the application.

  4. The provisions of Regulation 54 and Regulation 54A regarding secondment apply to articled assistants in training abroad.

  5. The Principal must submit training reports and service certificates in Forms 109 and 108, respectively.

  6. The stipends for articled assistants in training abroad will mirror those in India, adjusted to the local currency rates.

Working Conditions and Hours

  1. Training regulations regarding office hours and holidays will adhere to local laws while ensuring that total training hours are consistent with Indian norms:
  • a. Articled assistants should work 35 hours weekly, excluding lunch breaks.
  • b. Principal office hours for training should generally be between 9:00 a.m. and 7:00 p.m.
  • c. Articled assistants must start work no later than 11:00 a.m. and finish no earlier than 5:00 p.m.
  • d. Weekly hours must not exceed 35, excluding lunch breaks.
  • e. If work demands necessitate extra hours, the total for any week should not surpass 45 hours. Additional hours beyond the standard 35 will entitle the assistant to compensatory leave.

Regulatory Guidance for Conducting Training

  • Regulation 60: Specifies that the working hours of an articled assistant will be 35 hours per week, subject to Principal’s management.

  • Regulation 65: Prohibits articled assistants from engaging in other occupations without prior Council permission in the prescribed format.

  • Regulation 66: Outlines the process for investigating complaints against articled assistants, with potential outcomes including dismissal of the complaint or reprimand.

  • Regulation 67: Details the procedures for addressing complaints by articled assistants against their principals, including the potential for the principal's entitlement to be revoked.
