On May 16, 2024, the Food Safety and Standards Authority of India (FSSAI) released an advisory concerning the update process for modification applications related to food business licenses or registrations under the Food Safety Compliance System (FoSCoS).
In accordance with the FSS (Licensing and Registration of Food Businesses) Regulation, 2011, it is mandatory for Food Business Operators (FBOs) to keep their licensing authority informed of any significant changes. This includes modifications in product categories, facility layouts, or even the closure of operations, all of which must be communicated prior to implementation.
Previously, FBOs were permitted to submit only one modification application at a time. As a result, they faced delays since they had to wait for the approval of the current application before filing additional modifications. This often resulted in operational inefficiencies.
In response to feedback gathered during FSSAI-FBO meetings, the Food Authority introduced a new provision. During the 39th Meeting of the Food Authority held on July 13, 2022, it was approved that FBOs could now cancel and resubmit modification applications. This change aims to expedite the modification process, thereby enhancing efficiency for all parties involved, including FBOs and state food safety commissioners.
According to Section 2.1.9 (1) of the FSS (Licensing and Registration of Food Businesses) Regulation, 2011:
This advisory is intended for the following stakeholders:
The recent updates from the FSSAI regarding modification applications are designed to streamline the regulatory process for food business operators. All stakeholders are encouraged to familiarize themselves with these changes to ensure compliance and efficiency in operations.
