FSSAI Updates on Food Business License Modification Applications

FSSAI Advisory on Modification Applications for Food Business Licenses

On May 16, 2024, the Food Safety and Standards Authority of India (FSSAI) released an advisory concerning the update process for modification applications related to food business licenses or registrations under the Food Safety Compliance System (FoSCoS).

Importance of Notification for Food Business Operators

In accordance with the FSS (Licensing and Registration of Food Businesses) Regulation, 2011, it is mandatory for Food Business Operators (FBOs) to keep their licensing authority informed of any significant changes. This includes modifications in product categories, facility layouts, or even the closure of operations, all of which must be communicated prior to implementation.

Previous Challenges Faced by FBOs

Previously, FBOs were permitted to submit only one modification application at a time. As a result, they faced delays since they had to wait for the approval of the current application before filing additional modifications. This often resulted in operational inefficiencies.

New Provision to Expedite the Process

In response to feedback gathered during FSSAI-FBO meetings, the Food Authority introduced a new provision. During the 39th Meeting of the Food Authority held on July 13, 2022, it was approved that FBOs could now cancel and resubmit modification applications. This change aims to expedite the modification process, thereby enhancing efficiency for all parties involved, including FBOs and state food safety commissioners.

Key Regulations for Compliance

According to Section 2.1.9 (1) of the FSS (Licensing and Registration of Food Businesses) Regulation, 2011:

  • Notification Requirement: FBOs are mandated to ensure that their Registering or Licensing Authority is kept up-to-date with accurate information about their business activities.
  • Timeliness of Information: Any modifications, additions, or changes that could impact the license must be communicated before they occur.

Distribution of the Advisory

This advisory is intended for the following stakeholders:

  1. All Food Business Operators and Associations
  2. Food Safety Mitras
  3. Commissioners of Food Safety in all States and Union Territories
  4. Directors of FSSAI's Regional Offices

Conclusion

The recent updates from the FSSAI regarding modification applications are designed to streamline the regulatory process for food business operators. All stakeholders are encouraged to familiarize themselves with these changes to ensure compliance and efficiency in operations.
