With the GST Waiver Scheme now in effect, several taxpayers are opting to withdraw their pending appeals so that they can bring disputed demand orders under the new relief window. However, the process needs to be handled carefully to ensure eligibility under Section 128A and avoid processing delays.

1. When to Withdraw Your Appeal: Timing Matters

a) If Your Appeal Has Not Yet Received Final Acknowledgment (APL-02):

  • File your withdrawal request using Form APL-01W.
  • The GST system will automatically process this request.
  • The appeal status will change from "Appeal submitted" to "Appeal withdrawn" on its own.
  • No separate approval is needed from the Appellate Authority.

b) If Your Appeal Has Already Been Acknowledged (APL-02 Issued):

  • The withdrawal will require explicit approval from the concerned Appellate Authority.
  • Only after approval will the status update to "Appeal withdrawn".
  • This update is not automatic—keep an eye on your portal dashboard to confirm the change.

2. Why This Step Is Crucial: Section 128A Compliance

To avail the waiver, no appeal must be pending before the Appellate Authority.

  • The appeal is considered withdrawn only when the portal shows the updated status.
  • Once this appears, you’re legally in the clear to proceed with the waiver application under Section 128A.

3. What Proof You Need to Submit

To support your waiver application, you must upload evidence that the appeal is no longer pending.

When to Upload:

  • Either during your waiver application filing, or
  • As a supplementary document if the withdrawal was processed afterward.

Submit APL-01W once you've decided to withdraw. If APL-02 was already issued, monitor for Appellate approval. Take a clear screenshot of the updated status showing "Appeal withdrawn."
