On September 10, 2021, the Central Government issued a significant notification under the Income Tax Act concerning tax deductions for property transfers involving Air India Limited. This notification offers clarity regarding the application of Tax Deducted at Source (TDS) under section 194-IA.
TDS Exemption Details
According to Notification No. 106/2021-Income Tax, the Central Government specifies that:
- No TDS Deduction: There shall be no tax deduction under section 194-IA of the Income Tax Act on any payments made to Air India Limited for the transfer of immovable property to Air India Assets Holding Limited.
- Eligible Entities:
- Air India Limited (PAN: AACCN6194P)
- Air India Assets Holding Limited (PAN: AAQCA4703M)
This exemption applies to transfers carried out under a plan that has received approval from the Central Government.
Effective Date
The provisions of this notification are retroactively applicable from April 1, 2021, facilitating smoother financial transactions between the concerned entities.
