The Role of ITAT in Promoting Tax Justice and Social Equity

Introduction

On January 24, 2020, during the 79th Foundation Day Celebrations and the All India Members’ Conference of the Income Tax Appellate Tribunal (ITAT), Chief Justice of India, Mr. Justice S.A. Bobde, highlighted the issue of tax invasion as a significant social injustice affecting citizens. The Chief Justice emphasized the vital role of tax judiciary in resource mobilization and the need for advancements in judicial technology.

Tax Invasion and Social Justice

Mr. Justice Bobde expressed concern that tax invasion represents a social injustice, which affects fellow citizens adversely. He noted that arbitrary or excessive taxation also leads to an unfair burden on taxpayers. His comments underscored the importance of equitable tax practices in fostering societal trust and integrity.

Role of ITAT in Dispute Resolution

Addressing the audience, which included notable figures such as Justice M.R. Shah, President of ITAT, and Solicitor General of India, Shri Tushar Mehta, Mr. Justice Bobde acknowledged the crucial function of ITAT in providing effective dispute resolution. He emphasized that expeditious justice is essential in maintaining a civilized societal order and that a fair and swift resolution of tax disputes can act as an incentive for taxpayers to comply with their obligations.

Infrastructure and Technology in Justice Delivery

Mr. Justice Bobde stressed the necessity of improving infrastructure as a foundation for judicial effectiveness, comparing it to a healthy mind in a healthy body. He urged judicial institutions to continuously upgrade their skills and capabilities. The Chief Justice further discussed the exciting potential of artificial intelligence (AI) in enhancing judicial processes, especially in docket management and decision-making. He cautioned, however, against allowing AI to replace human judgment, which is essential for just adjudication.

Remarks from the Solicitor General

Shri Tushar Mehta highlighted that the tribunal operates under strict rules of evidence, comprising both Judicial Officers and Accounting Members. This dual functionality has proven beneficial in resolving taxation issues effectively. He reiterated that the prompt settlement of disputes ultimately benefits taxpayers and strengthens the national economy.

Commitment to Justice

In his welcome address, President of ITAT, Mr. Justice P.P. Bhatt, called for a renewed commitment to serving society through the just resolution of direct tax matters. He emphasized that the organization’s guiding principles—Nispaksh (impartial), Sulabh (accessible), and Satvar (swift) Nyay—are not just slogans but foundational values that embody their mission.
