SEBI's Investor Charter: Enhancements in Grievance Redressal for Investors
Introduction
The Securities and Exchange Board of India (SEBI) has introduced an Investor Charter aimed at guiding investors within the Indian Securities Market. This Charter outlines the rights and responsibilities of investors as well as essential do’s and don’ts for investing in the securities market.
Enhancements in Investor Grievance Redressal Mechanism
SEBI prioritizes the resolution of investor grievances as a fundamental aspect of investor protection. Recently, several measures have been implemented to strengthen the Investor Grievance Redressal Mechanism:
-
Monthly Status Reports: SEBI now publishes monthly status reports detailing the disposal of investor grievances reported on the SCORES portal, enhancing transparency.
-
Public Disclosure of Grievance Pendency: Monthly updates are provided on the SEBI website regarding the names of companies, intermediaries, and market infrastructure institutions (MIs) with prolonged grievance pendency.
-
Disclosure Requirements: Starting January 2022, all SEBI-regulated intermediaries and entities must disclose the average time taken to resolve investor grievances on their websites, following a format specified by SEBI.
-
Investor-Friendly Norms: SEBI has implemented various initiatives to simplify processes for investors, driven by feedback from reported grievances. Recent circulars have addressed:
- Simplified norms for processing requests from Registered Transfer Agents (RTAs).
- Easier nomination procedures for holders of physical securities.
- The simplification of share transmission for joint holders.
-
Alternate Dispute Resolution Mechanism: SEBI has introduced an alternative dispute resolution mechanism for grievances against brokers and depository participants at the Stock Exchanges and Depositories. The possibility of establishing similar mechanisms for other registered intermediaries and entities is currently under review.
